RENTAL POLICY & AGREEMENT
Condition After the Completion of the Event: The Renter shall leave the space, equipment, and furniture in the same condition as received from Cloakroom. Renter shall be responsible for any costs related to damage caused by Renter’s use of the space or equipment, as well as anything that may go missing, including if the door is not properly closed upon leaving, resulting in theft. Any downtime for repairs will be charged.
Cleanup: Renter will be responsible for clearing all trash & recycling generated at the event beyond what our bins can hold. Any furniture or equipment must be returned to its original location. Failing to clean up after your event will result in a $100/hr cleanup fee. Brooms and mops are available on site. Consider that there may be an event/rental directly following yours.
Elevator: The freight elevator on site is only to be used for material loading. Failure to lock the loading dock door entirely, and close elevator doors, leaving the building vulnerable, will result in a $150 fine. The alleyway in front of the loading dock is only a 15 minute loading zone; any tickets/tow fees will be the Renter’s responsibility.
Right of Entry: The rental time indicated on your invoice is the time you have access to the space; please include any necessary setup/cleanup time in your rental. Cloakroom staff shall have the right to enter the space at any time for any reasonable purpose, including any emergency that may threaten damage to Cloakroom property, or injury to any person in or near the space. Renter shall not be allowed in the space past 12:00am, and absolutely no music/loud noise past 11:00pm. Anyone found in violation of this term will be subject to a $350 fine.
Indemnification: Renter shall have in place, or obtain any necessary insurance or permits required for their event, at their own expense and time, and provide proof of insurance. Renter hereby indemnifies and holds harmless Cloakroom from damages, actions, suits, claims, fines, or other costs (including reasonable attorneys’ fees) arising out of or in connection with any damage to any property or any injury caused to any person (including death) caused by Renter’s use of the space, including any acts or omissions on the part of the Renter, its employees, officers, directors, independent contractors, or other agents. Renter shall notify Cloakroom of any damage or injury of which it has knowledge in, to, or near the space, regardless of the cause of such damage or injury. *Social distancing in effect* Cloakroom cannot be held liable for any illness that may arise from the gathering of the Renter or their guests. Any incurred fines from the city for not following current public health orders/social distancing will be the responsibility of the Renter.
Revocation: Cloakroom shall have the right to cancel the booking at any time prior to the rental date, provided it gives the Renter prior written notice of revocation. In the event that Cloakroom cancels the booking prior to the event for reasons other than nonpayment or breach of this agreement by the Renter, Cloakroom shall refund to the Renter the full amount paid by the Renter in connection with this agreement..
Cancellation/Payment: Renter may cancel the rental by notifying Cloakroom by providing notice seven (7) days or more before the Rental Date. In such an event, Cloakroom shall refund to the Renter 50% of the full amount of the rental charge. In the event the rental is cancelled within less than seven (7) days of the rental date, Cloakroom shall have the right to retain the full rental charge.
*In light of the COVID-19 outbreak, there will be no penalty for rescheduling at any point leading up to your booking. Cancellations will be accepted with no penalty at any time leading up to your booking accompanied by a doctors note/positive test result*
Assignment: Neither party may assign or transfer their respective rights or obligations under this agreement without prior written consent from the other party. Governing law of this agreement shall be construed in accordance with, and governed in all respects by the laws of the Province of Manitoba, without regard to conflicts of law principles.
Photography/Video: Cloakroom retains the right to use any photos or video produced in the space by the Renter, for promotional and social media use only.
Alcohol: The sale and use of alcohol is prohibited in the space. If you are found in violation of this term, any incurred fines by the city will be the responsibility of the Renter.
Entire Agreement: This agreement constitutes the entire agreement between the Renter and Cloakroom Wellness, and supersedes any prior understanding or representation of any kind preceding the date of this agreement. There are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this agreement.
